When the real estate where the franchise business is located will secure the SBA-guaranteed loan, the Lease Addendum, the Collateral Assignment of Lease, and the Lease Back Agreement, may not be executed. 2. The Right of First Refusal and Option Agreement may not be executed when the franchsiee or an affiliate of the franchisee owns the real estate taken as collateral for the SBA Loan. 3. Lender/CDC must ensure they obtain the correct lien position on all collateral as required pursuant to the SOP 50 10. 4.
