1. When the real estate where the franchise business is located will secure the SBA-guaranteed loan, the Franchise Addendum to Lease Agreement, may not be executed. 2. Franchisor may not enforce the Purchase Option on Real Estate owned by the franchisee or an affiliate of the franchisee and taken as collateral for the SBA Loan. 3. Applicants operating under an Area Representative Agreement are NOT eligible for SBA financing. 4. If Applicant also operated under a management agreement with a third party, Lender/CDC must review the management agreement in accordance with SOP 50 10 to determine if there is affiliation between the Applicant and the management company. 5. Lender/CDC must ensure they obtain the correct lien position on all collateral as required pursuant to the SOP 50 10.
